Terms & Conditions of Standard Chartered Debit Card
Chapter One General Provisions
ARTICLE 1 To regulate the issuance and use of the Standard Chartered Debit Card issued by Standard Chartered Bank (China) Limited ("SCB"), prevent the risks in debit card business, provide better financial services to the general public, and safeguard the rights and interests of SCB and the cardholders, these articles ("Articles") are hereby formulated in accordance with the Regulations on the Administration of the Savings issued by the State Council, and Measures on the Administration of the Bank Cards Business, Measures on the Administration for the RMB Bank Settlement Accounts issued by the People's Bank of China and other relevant regulations.
ARTICLE 2 In these Articles, Standard Chartered Debit Card refers to financial payment instrument issued by SCB to the general public with some or all functions like consumption settlement, transfer payment, deposit and withdrawal and account management and can be used at the SCB outlets, via phone banking, online banking, multimedia terminals and other self-service equipment and special nominated supplier and ATM with China Union Pay logo. Standard Chartered Debit Card does not posses overdrawing function, and it is required to make a deposit to the account before making debit payment.
ARTICLE 3 SCB and the cardholders of Standard Chartered Debit Card ("Cardholders") shall jointly observe these Articles.? All cards under the Standard Chartered Debit Card series shall be subject to their own articles, if there are articles in case of need, and these Articles.
Chapter Two Application Requirements
ARTICLE 4 The target of issuance of Standard Chartered Debit Card shall be the natural persons in China (inclusive of Chinese citizens, foreigners in China, compatriots of Hong Kong, Macao and Taiwan) who are qualified for the application requirements set forth by SCB. The application of Standard Chartered Debit Card shall be consistent with the provisions of national real-name system and the real-name accounts shall be used.
ARTICLE 5 When applying for a Standard Chartered Debit Card, the applicant shall provide relevant application information as required by SCB, and fill in an applicant form, and his/her signing on the application form shall indicate that the applicant has been aware of the relevant provisions of SCB, and is liable for the genuineness of the content he/she has filled and confirms that he/she will honor all the provisions stipulated in the Standard Chartered Debit Card contract, and observe these Articles. SCB shall issue the Standard Chartered Debit Card to the person who is qualified for the application requirements.
Chapter Three Interest Calculation and Charging Rate
ARTICLE 6 The interest accrued on the deposit in a Standard Chartered Debit Card account shall be calculated and paid in accordance with the deposit interest rate of the same term and same grade and the methods for interest calculation as prescribed by the People's Bank of China, and the interest tax shall be withheld according to law.
ARTICLE 7 Each specific charging item for Standard Chartered Debit Card and the rate thereof are set forth in the relevant fee schedules of SCB, and the service fee rates shall be subject to the notices on SCB's website or at its business outlets. SCB has the right to charge all service fees in accordance with the rates. In case a Cardholder fails to pay the relevant fees, SCB shall have the right to either deduct the amount equivalent to the required amount from the accounts opened by the Cardholder with SCB, or terminate the provision of relevant services.
ARTICLE 8 SCB shall have the right to formulate and adjust charging items and rates in accordance with the relevant regulations of the State and the need of the issuance of different cards under the Standard Chartered Debit Card series.
Chapter Four Account and Transaction Management
ARTICLE 9 The funds deposited in an individual card account shall be the cash held by the person, or the wages, personal legitimate labor remunerations, and investment returns deposited through account transfer.
ARTICLE 10 In case a Cardholder withdraws cash via a domestic ATM, the accumulated amount of the cash that can be withdrawn each day for each card shall be subject to the provisions of the People's Bank of China.? In case a Cardholder withdraws cash overseas, the accumulated amount of the cash that can be withdrawn each day for each card shall be strictly subject to the provisions of the State Administration of Foreign Exchange ("SAFE").
ARTICLE 11 The electronic information records of the depositing and withdrawing, account transfer and settlement or any other transaction of a Cardholder with a PIN code shall be deemed as the valid credentials of such transaction, and shall be taken as the evidence for bookkeeping.
ARTICLE 12 Standard Chartered Debit Card shall be valid for a long term, and within the term, in case a Cardholder needs to change the old card for a new one because of the damage to the old card or the magnetic stripe degaussing, he/she could go to SCB to go through the relevant formalities in respect of replacement with the old card, his/her valid ID card, and relevant fees to be paid by the Cardholder.
ARTICLE 13 In the event a Cardholder ceases to use the Standard Chartered Debit Card, he/she shall go through the formalities in respect of cancellation in accordance with the relevant provisions of SCB, and SCB shall take back the card.
Chapter Five Rights and Obligations of Cardholders
ARTICLE 14 Cardholders shall have the right to all kinds of services regarding the Standard Chartered Debit Card as promised by SCB, and the right to supervise the service quality and complain against SCB for its incompetent services.
ARTICLE 15 Cardholders shall have the right to be informed of the functions, methods of use, charging items, charging rates, applicable interest rates and the relevant calculation formula of Standard Chartered Debit Card.
ARTICLE 16 Cardholders shall have the right to demand account statements from the outlets of SCB, to inquire about the account statements via Phone banking and self-service equipment, or print the transaction list within the prescribed time limit by SCB in accordance with relevant provisions, and shall have the right to inquire about the discrepancies of the content.
ARTICLE 17 Cardholders shall report the loss of the cards or the PIN codes and conduct relevant formalities in respect of reporting loss, and after the completion of such formalities, a Cardholder shall not be liable for the change of the funds in a relevant account, unless otherwise prescribed by the laws and regulations of the State.
ARTICLE 18 An applicant applying for Standard Chartered Debit Card shall guarantee the genuineness of the information provided by him/her. SCB shall provide enquiry services to Cardholders. ?An applicant shall provide genuine personal information to SCB, and shall inform SCB of the change of his/her personal information in writing in a timely manner, otherwise he/she shall be liable for all the losses or any delay arising therefore.
ARTICLE 19 Cardholders shall keep the cards safe and use the PIN codes correctly. Any losses arising from the improper keeping and use of the card shall be borne by Cardholders. All the electronic information records of all the transactions conducted by SCB for Cardholders according to the PIN codes shall be deemed as the valid credentials of such transactions.
ARTICLE 20?Cardholders shall keep the Standard Chartered Debit Card safe, and shall bear all the losses arising from the improper keeping of the card. SCB has established 24-hour Customer Service Hotline. In case a Cardholder loses the card or his/her card has been stolen, he/she needs to report the loss of the card to SCB orally in a timely manner and conduct the formalities of reporting the loss of the card in writing at an adjacent outlet of SCB, or he/she could conduct the formalities of reporting the loss of the card in writing directly. The reporting of loss shall come into force immediately upon the completion of the formalities. Any economic losses suffered by a Cardholder before his/her reporting of loss shall be borne by the Cardholder. A Cardholder may apply for a new card seven (7) days after his/her reporting of loss by producing the application form of reporting of loss and his/her valid certificate, with the relevant fees to be paid by him/her.
ARTICLE 21 Standard Chartered Debit Card shall be used by the Cardholder himself/herself, and the Cardholder shall not lend or rent it to any other person. A Cardholder shall bear all the losses arising from his/her improper keeping of the card, his/her lending or renting the card to any other person or his/her improper use of the card.
Chapter Six Rights and Obligations of SCB
ARTICLE 22 SCB shall have the right to check and examine the background and the credit status of an applicant, to demand for the personal information of an applicant, and to decide whether to issue the Standard Chartered Debit Card to the applicant.
ARTICLE 23 To protect the funds in the account of a Cardholder, SCB shall have the right to temporarily suspend the payment from the account upon awareness of the risks of falsely using of the card by other person.? In the case whereby SCB discovers that the Cardholder does not observe these Articles or is in violation of other regulations and laws, SCB shall have the right to terminate the Cardholder's right to use the card, and authorize relevant entities to take back the Standard Chartered Debit Card.
ARTICLE 24 SCB shall have the right to assist state judiciary bodies or other state authority bodies in the inquiry, freeze or deduction of a Standard Chartered Debit Card account of a Cardholder in accordance with provision of laws.
ARTICLE 25 In the event that the Standard Chartered Debit Card cannot be used because of force majeure or other objective reasons, SCB shall help the Cardholders solve the problem or render necessary assistance in accordance with the situations, provided that SCB shall not be liable for this.
ARTICLE 26 SCB shall have the right to charge annual fees and service fees in accordance with the business conditions.
ARTICLE 27 SCB shall provide applicants with relevant materials with regard to the use of Standard Chartered Debit Card and such materials shall include these Articles, statement of use and charging rates.
ARTICLE 28 SCB shall announce the telephone number for 24-hour service, and provide services regarding business consultancy, account inquiry, and reporting of loss of cards and PIN codes.
ARTICLE 29 SCB shall keep confidential the credit information regarding Cardholders unless otherwise prescribed by the laws and regulations of the State.
Chapter Seven Supplementary Provision
ARTICLE 30 These Articles are formulated and construed by SCB. SCB shall have the right to amend these Articles in accordance with the laws and relevant regulations of the State. ?The provisions of these Articles after being amended shall be equally binding on all the parties.
ARTICLE 31 The relevant disputes between SCB and Cardholders regarding debit card business shall be settled in accordance with these Articles or through legal solutions.
ARTICLE 32 Any matters uncovered by these Articles shall be subject to the relevant laws, regulations and rules of the State.
ARTICLE 33 These Articles shall be implemented from the date when being officially approved and announced.
